Affordable Housing:

Housing Policy and Legislation

HAO lawyers are actively involved in helping to shape the federal laws and policies that regulate the multifamily affordable housing sector. Firm attorneys regularly respond to opportunities to provide comments in the federal rulemaking process and are asked by HUD to provide feedback on new and changing HUD rules and policies. Firm founders Tim Aluise and Art Hessel have played a role in nearly every major multifamily HUD program in the last 30 years, helping to develop rules and programs that maximize client interests and advance affordable housing policy goals. Such programs include:

  • FHA insured loan transactions
  • Section 8 (project based and vouchers)
  • HUD subsidized mortgages (i.e., Sections 236, 221(d)(3))
  • Housing preservation programs including  ELIHPA, LIHPRHA, Mark-to-Market, and the Section 236 decoupling program
  • Section 202 refinancings
  • Regulatory transfers
  • Tax exempt bond and tax credit transactions with HUD federal subsidy involvement

More recently, HAO attorneys have provided advice and comment on:

  • Revisions to the legal documents governing FHA insured loans
  • Changes to the Section 8 Renewal Guide
  • Major developments in the Section 202 elderly housing program
  • Expansion of GNMA authority for credit enhancement
  • HUD’s Rental Assistance Demonstration Program (RAD)
  • Expansion of State Housing Finance Agency Risk Share Program
